Terms of service

These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you") and MarvinJWendt ("we", "us", "evnt.cam"), based in Germany, governing your access to and use of our platform and services (the "Service"). By accessing or using evnt.cam you agree to be bound by these Terms. If you do not agree to them, you may not use the Service.

1. Description of the service

evnt.cam lets a host create an event, share a link and a QR code, and collect the photos that guests take at that event in one shared gallery. Guests need no account. The Service handles photos only; it does not accept video.

2. Your responsibilities

2.1. The host

The host of an event bears full and sole responsibility for everything connected to that event: its name, its description, and every photo uploaded to it, whether by the host or by a guest through the shared link.

2.2. Uploads

Anyone holding the link to an event can open it and, while the event is open for uploads, add photos to it. Every photo uploaded to an event is immediately visible to everyone holding that link, unless the host has turned the gallery off, in which case the photos go to the host alone.

2.3. Compliance with the law

You agree to use evnt.cam in compliance with all applicable local, national and international law. This includes, without limitation, data protection and privacy law (such as the GDPR), intellectual property law, and content regulation.

3. Prohibited content

When uploading or otherwise transmitting any content to evnt.cam, you may not submit material that:

  • Contains personal data of others without their consent. Photos must not contain personally identifiable information about individuals without their explicit, prior consent. This includes recognisable faces, licence plates, and any other identifying or biometric feature. The person uploading is responsible for having obtained that consent.
  • Infringes intellectual property. You guarantee that you hold all rights, licences and permissions needed to upload and distribute the photos you submit.
  • Is illegal, harmful or exploitative. Uploading, distributing or linking to illegal material, including Child Sexual Abuse Material (CSAM), is strictly prohibited. As a hosting platform we do not proactively monitor user content and assume no liability for it. On becoming aware of such material, whether through a report or otherwise, we permanently delete the photo and, where warranted, the whole event, terminate the offender's access, and report the matter to the competent authorities.
  • Violates the rights of others. This includes defamatory, obscene, abusive, hateful or otherwise seriously objectionable content.

4. Moderation and deletion

4.1. The host's rights and duties

A host may hide any photo in their event, including photos uploaded by guests, and may delete the event at any time. Deleting an event permanently deletes every photo in it. A host who becomes aware of a photo that violates these Terms is obliged to remove it. Where a host does not, evnt.cam may remove the photo or the event.

4.2. Guests

Guests upload without an account and therefore cannot delete their own uploads afterwards. A guest who wants a photo removed can report it, or ask the host to remove it.

4.3. Reports

Anyone who can see a photo can report it to us; our support page says how. A report records the reason, an optional note, and a technical value used only to limit abuse of the report function. We review every report, and the outcome may be that the photo is hidden, deleted, or left in place.

4.4. Our rights

We reserve the right, at our sole discretion, to review, hide or delete any photo or event that violates these Terms or is otherwise harmful, at any time, with or without prior notice.

5. Plans, limits and retention

Every event carries a plan. The plan sets how many photos the event accepts, how long its upload window may be, how many events you may run at once, and how long the photos are kept after the event ends. The limits in force are shown in the app and on our website.

When an event's retention period ends, every photo in that event is permanently deleted. The event itself remains as a record of the name, the date and the number of photos it held. We usually send a reminder before that happens, but you are responsible for downloading anything you want to keep in time.

6. Rights you grant us

By uploading a photo to evnt.cam you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, display and transmit that photo solely to operate and deliver the Service for that event. You keep all ownership rights in your photos.

7. Disclaimer and limitation of liability

7.1. "As is"

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2. Limitation

To the maximum extent permitted by law, evnt.cam, MarvinJWendt, and its affiliates, directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, revenue, data, use or goodwill, arising from (a) your access to or use of, or inability to use, the Service, (b) the conduct or content of any third party on the Service, or (c) unauthorised access to or alteration of your content.

8. Indemnification

You agree to indemnify and hold harmless evnt.cam (MarvinJWendt) and its affiliates, directors, employees and agents against any claim, damage, obligation, loss, liability, cost or expense, including reasonable legal fees, arising out of or in connection with (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any third-party right, including copyright, property or privacy rights, or (d) any claim that content you submitted caused damage to a third party.

9. Changes to these terms

We may modify or replace these Terms at any time without prior notice. It is your responsibility to check them for updates. Continuing to use the Service after a change constitutes your acceptance of it.

10. Governing law

These Terms are governed by the law of the Federal Republic of Germany, without regard to its conflict of law provisions. The courts of Germany have exclusive jurisdiction over any matter arising from these Terms or from use of the Service.
