Terms of Service

Welcome to evnt.cam. These Terms of Service ("Terms") formulate a legally binding agreement between you ("User", "you") and MarvinJWendt ("we", "us", or "evnt.cam"), a company registered in Germany, governing your access to and use of our platform and services (collectively, the "Service").

By accessing or using evnt.cam, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

1. Description of Service

evnt.cam provides a platform enabling users to create digital event albums, upload media (e.g., photos and videos), and share access links with guests who can view and contribute to these event albums.

2. User Responsibilities and Conduct

2.1. Event Creators

The creator of an event bears full and sole responsibility for all content associated with their event. This includes, but is not limited to, the event title, description, and any media uploaded either by the creator or any guests via the shared link.

2.2. Media Uploads

Everyone with the link to an event can view the content and upload media to that event. All media uploaded to an event is immediately and unconditionally visible to any person possessing the event link.

2.3. Compliance with Laws

You agree to use evnt.cam in compliance with all applicable local, national, and international laws and regulations. This explicitly includes, but is not limited to, data protection and privacy laws (such as the GDPR), intellectual property laws, and content regulations.

3. Content Restrictions and Prohibited Use

When uploading, posting, or otherwise transmitting any media or content to evnt.cam, you are strictly prohibited from submitting material that:

  • Contains Personally Identifiable Information (PII): Pictures and videos uploaded must not contain any PII of individuals without their explicit, prior consent. This includes, without limitation, recognizable faces, license plates, and any other identifiable features or biometric data. The uploading user is entirely responsible for ensuring they have obtained necessary consents before uploading.
  • Infringes Intellectual Property: You must ensure that all media uploaded does not infringe upon the intellectual property rights of any third party, including copyright, trademarks, and trade secrets. You guarantee that you possess all necessary rights, licenses, and permissions to upload and distribute the media.
  • Is Illegal, Harmful, or Exploitative: The uploading, distribution, or linking to illegal materials, including Child Sexual Abuse Material (CSAM), is strictly prohibited. As a hosting platform, evnt.cam does not proactively monitor or assume liability for user-uploaded content. However, immediately upon becoming aware of such illegal material (e.g., via reports to our support team), we will permanently delete the media and/or event, terminate the violator's access, and make a mandatory report to the appropriate law enforcement authorities.
  • Violates Third-Party Rights: This includes content that is defamatory, obscene, malicious, abusive, invasive of privacy, hateful, or otherwise highly objectionable.

4. Content Moderation and Deletion

4.1. Creator Responsibility and Rights

Event creators have the right and obligation to delete any media uploaded to their event that violates these Terms, including media uploaded by their guests. If an event creator fails to remove media that violates the Terms, evnt.cam reserves the right to forcefully delete the violating media or the entire event. The creator may delete their event at any time. Doing so will permanently delete all media uploaded to that event and unequivocally remove the event from our Service.

4.2. Guest Uploads

Guests who upload media to an event operate without registered user accounts; consequently, they cannot independently delete their own uploads once submitted. If a guest wishes to have their uploaded media removed, they must contact the creator of the event and request its deletion.

4.3. Administrative Rights

The administration of evnt.cam reserves the absolute right, at its sole discretion, to review, moderate, and delete any media or event that violates these Terms or is otherwise deemed harmful or inappropriate, at any time, with or without prior notice.

5. Rights Granted

By uploading media to evnt.cam, you grant evnt.cam a worldwide, non-exclusive, royalty-free, and fully paid-up license to use, display, reproduce, and distribute the media solely in connection with the operation, provision, and technical delivery of the Service for that specific event. You retain all ownership rights to your submitted media.

6. Disclaimers and Limitation of Liability

6.1. "As Is" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. evnt.cam explicitly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2. Limitation of Liability

To the maximum extent permitted by applicable law, evnt.cam, MarvinJWendt, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to, use of, or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to indemnify, defend, and hold harmless evnt.cam (MarvinJWendt) and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or in connection with: (a) your use of and access to evnt.cam; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that material submitted by you caused damage to a third party.

8. Modifications to the Terms

The administration of evnt.cam reserves the right to modify or replace these Terms at any time, without prior notice. It is your responsibility to proactively check the Terms for updates. Your continued use of the Service following the posting of any changes to these Terms constitutes your explicit acceptance of those changes.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Germany to resolve any legal matter arising from these Terms or the use of the Service.
